Parliament to debate payout regulation for 131 liquidated funds
While the uncertainty created by mutual funds placed into liquidation in the capital markets continues, the legal framework for collecting the claims of beneficiaries has been brought to the agenda of Parliament. The 9-article bill submitted by the AK Party, concerning 455 thousand 758 investors, will be debated on Wednesday, October 14 at the TBMM Planning and Budget Commission.
The regulation covers 131 investment funds belonging to 7 fund companies placed into the liquidation process in line with the decisions of the Capital Markets Board (CMB) dated September 17, 2026. Under the bill, the processes for converting fund assets into cash, transferring payments to beneficiaries, and collecting incurred losses from liable parties are secured under law.
The CMB will assume a decisive role in the management of liquidation operations. In confirming beneficiary status, data from the Central Securities Depository, Takasbank, the Turkey Electronic Fund Trading Platform, and portfolio custody and distribution institutions will be cross-checked. The Board will determine the distribution order regarding the identification, valuation, and liquidation of fund assets, as well as making interim and final payments to beneficiaries.
How will interim and final payments to investors be made?
A limit of 1 million lira (TRY) will be taken as the basis for transfers to investors. An initial interim payment not exceeding this amount will be granted to those whose net investment amount remains below 1 million lira, and at most 1 million lira to those with a portfolio above 1 million lira. The initial payments, to be transferred on the unindexed net amount, will be covered from the current assets of the funds and the amounts collected or recovered from liable parties. In the calculation of final payments, the net principal is envisaged to be updated with the arithmetic average of the rates of change in consumer price inflation (CPI) and domestic producer price index (D-PPI).
Which institutions will oversee the liquidation process?
Under the regulation, no payments will be made to individuals and institutions determined to have engaged in or participated in insider trading, market fraud, or market-disrupting actions within the scope of the Capital Markets Law. Following the conclusion of negotiations in the commission, the bill is scheduled to be voted on the following week in the TBMM General Assembly.
