Justice Ministry warns on refunds in fund probe
The Ministry of Justice announced that voluntary refunds will not eliminate the legal liability of suspects in the capital markets fund investigation where 15 people have been arrested. Justice Minister Akin Gurlek stated in a post on his social media account that the process is being monitored directly to preserve confidence in the markets and resolve investor grievances.
Do voluntary refunds prevent penalties?
Clarifying the legal nature of voluntary refunds, Minister Gurlek underlined that making a refund alone will not erase the liability of any natural person or legal entity. Gurlek said, 'These refunds, which contribute to resolving grievances, do not constitute an obstacle to conducting investigations or evaluating evidence. Our priority is to ensure that refunded amounts reach their rightful owners.' Judicial authorities are examining in detail the source, timing, amount, and method of transfer of refunds to victims.
Are additional asset measures coming in the fund investigation?
The Istanbul Chief Public Prosecutor's Office, which is conducting the investigation, is applying protective measures to prevent the dissipation, transfer, and concealment of assets. Newly obtained evidence will pave the way for judicial authorities to impose additional asset measures. Throughout the process, opportunists will be distinguished from bona fide savers, and joint work with other institutions will continue to identify illicit gains.
The case file before judicial authorities, which includes 15 arrests and 5 new detentions, involves allegations of illicit gains in the markets. Minister Gurlek added that no unlawful act will go unpunished and that the process will be pursued to the end for full justice to be served.
